2 cops shot during deadly NY subway gunbattle

NEW YORK -?Two New York City police officers were shot by a subway rider Thursday before the suspect was killed in an ensuing exchange of gunfire, officials said.

The incident occurred just an hour after an off-duty NYPD officer was shot in the Bronx.

The plainclothes officers involved in the subway incident stopped the suspect after he was spotted walking between cars on a N train, Mayor Michael Bloomberg said at a press conference.?

When asked for identification, the suspect acted as if to comply but then pulled out a 9-millimeter Taurus and opened fire on the officers, Bloomberg said. Officer Michael Levay, 27, was hit in the lower back while colleague?Lukasz Kozicki, 32, was hit three times: once in each thigh and once in the groin. Levay was able to return fire, killing the suspect.

One passenger was grazed in the?gunbattle?and wasn't seriously hurt, Police Commissioner Ray Kelly said. Other passengers on the train were able to flee onto the platform at Fort Hamilton Parkway stop in Brooklyn?when the gunfire erupted. Neither the platform nor the train was crowded at the time.

Kozicki and Levay were taken to Lutheran Medical Center, where they were listed in stable condition.?

Earlier Thursday night, an off-duty officer was shot in the Bronx?during an apparent robbery attempt at his family's auto dealership.

Two suspects feigned interest in one of the cars near the dealership office in Williamsbridge, then took out a gun and forced the officer, identified as Juan Pichardo, and an employee to the floor in the back office, Kelly said at a press conference. The robbers ransacked the office, while holding a gun toward Pichardo's face.

Pichardo, who was not armed, later stood up and grabbed the gunman. The would-be robber shot the off-duty officer in the right thigh, Kelly said. However, Pichardo managed to overpower the gunman with the help of the other employee and wrestled him to the ground, disarming him.?

Three other suspects were later also arrested. Pichardo was also listed in stable condition.

A total of 12 New York City officers were shot during 2012, according to Bloomberg.?

"Sometimes the good guys get shot, and sometimes they are killed," Bloomberg said. "Tonight, thank God, three good guys -- three New York City police officers who acted heroically -- are going to make it."
