NY bill would require bachelor's degrees for RNs

(AP) ? New registered nurses would have to earn bachelor's degrees within 10 years to keep working in New York under a bill lawmakers are considering as part of a national push to raise educational standards for nurses, even as the health care industry faces staffing shortages.

The "BSN in 10" initiative backed by nursing associations and major health policy organizations aims to attack the complex problem of too few nurses trained to care for an aging population that includes hundreds of thousands of nurses expected to retire in the coming years. But some in the health care industry worry that increased education requirements could worsen the problem by discouraging entrants into the field.

Currently, most registered nurses have two-year associate's degrees. No state requires a four-year degree for initial licensing or afterward, though New Jersey and Rhode Island have considered proposals similar to New York's over the past several years. New York's legislation died in committee last session, but it has bipartisan support in both chambers this year and could be debated as early as January.

Demand for more skilled nurses is increasing as the population gets older and has more chronic diseases, and as the new federal health care law promises to help 32 million more Americans gain insurance within a few years.

Federal health officials have recommended upgrading nurse education to BSNs for more than a decade, and the idea got a boost in a 2010 report, "The Future of Nursing," by the National Academy of Sciences nonprofit Institute of Medicine and the Robert Wood Johnson Foundation. As of 2008, about a third of RNs had bachelor's degrees or higher, according to federal statistics. The institute recommended increasing that to 80 percent by 2020.

Advocates say that in addition to improving patient care, a key reason for requiring more education is to put more nurses in position to move on to jobs in administration and in-demand specialties like oncology, and to teach at nursing schools, where the average faculty age is 53.

"More and more hospitals are looking to hire BSNs, but the catch is that not that many schools offer the RN-to-BSN program or have the faculty to teach it," said Sharon Shockness, an adjunct teacher at Mercy College in Westchester County.

The New York bill's main sponsors, Democratic Assemblyman Joseph Morelle of Rochester and Republican Sen. James Alesi of Monroe County, said the bill is needed to further professionalize nursing. Both serve on their respective higher education committees and represent districts that include University of Rochester Medical Center and St. John Fisher College, which have BSN programs.

In addition to helping provide future teachers, the lawmakers say the added education and critical thinking skills are needed as patient care has become more sophisticated and studies show staff with higher levels of education serve patients better.

In a memo supporting the bill, the New York State Nurses Association cites a 2003 University of Pennsylvania study that found every 10 percent increase in staffing by nurses with bachelor's degrees results in a 5 percent decrease in surgical deaths.

Current registered nurses would be exempt from the education requirement to prevent driving more nurses from the field.

"This bill shouldn't discourage anyone at this point because it doesn't involve anyone even applying for licensure right now ... and 10 years is a long time to get a degree that will give you better pay," Alesi said.

Alesi contends the measure will "improve the landscape of nursing" by increasing the pool of RNs who can go on to obtain master's degrees and teach.

Researchers say almost 900,000 of the nation's roughly 3 million licensed RNs are older than 50, and while there's been an uptick in new, younger nurses, shortages are still expected as the health care industry continues to add nursing jobs. The federal Bureau of Labor Statistics estimated in 2009 that almost 582,000 new RN jobs would be created by 2018.

Federal projections in 2004, the most recent available, forecast a shortfall of 54,000 RN jobs in New York by 2020; the state currently has about 170,000 working nurses. But the state and national shortage estimates have varied greatly as the overall economy and national health policy have changed. A study published this year in the journal Health Affairs reports a surge among younger RNs entering the workforce, pointing to an easing of a national shortage previously forecast to reach 400,000 by 2020.

That shortage concerns New York's health care providers.

William Van Slyke, spokesman for the Healthcare Association of New York State, said the organization representing health care networks and hospitals supports having a better educated nursing workforce, but opposes a four-year degree mandate.

One problem, he said, is the lack of nursing faculty ? the same issue advocates say the bill would address.

"If you start the clock and you don't have the educational system, we may find ourselves having to turn away staff and have shortages," Van Slyke said.

The association has proposed legislation that would provide incentives like loan forgiveness to encourage people to become nurse educators, he said, but lawmakers haven't taken up the idea.

Morelle, the Assembly sponsor, said the state's community colleges also have expressed concerns that the requirement will cut into the number of people seeking the 2-year degrees they offer.

"Their classes are overflowing," Morelle said, and there is a "whole host of programs" that allow students to progress from a 2-year to a 4-year program.

A spokesman for the New York nurses association said New York City metropolitan area hospitals are increasingly requiring new RNs to have a bachelor's degree or earn one within five years, creating a disparity in standards between downstate and upstate, where fewer candidates have four-year degrees.

"Even without the legislation in place, hospitals and other medical facilities are making hiring decisions that favor those with BSN degrees over those without them," said Dr. Peggy Tallier, program director and associate professor in nursing school health at Mercy College.

Cops: Mom, son rescued after Facebook post

A Utah woman used Facebook to seek help after she and her 17-month-old son were held hostage at a residence for nearly five days, police said.

Police Sgt. Jon Arnold said the woman hid in a closet with a laptop to post her plea for help on the social networking website, saying she and her son would be "dead by morning" if they were not rescued.

The post prompted someone to call police, who went to the home to check on the woman's welfare.

"Facebook was her only outlet that she had at the home," Arnold said. "It just happened that she was able to use it."

Police arrested Troy Reed Critchfield, 33, and booked him into jail Saturday for investigation of aggravated kidnapping, forcible sodomy, aggravated assault, domestic violence, child abuse, animal cruelty and other charges.

Salt Lake County Jail records show Critchfield initially refused to let police in the house.

The papers say the woman shook her head to indicate "No," when officers asked if she was OK.

After police separated the couple, the woman told officers she and her child had not been allowed to leave the home and that she repeatedly had been hit, choked and sexually abused over a period of nearly five days. Jail records show the woman also claimed Critchfield had taken her cell phone and the phone of a disabled child also in the home.

"She claims that any time she went to go to a door, he physically assaulted her," Arnold told The Associated Press on Monday.

The woman had bruises and other physical injuries consistent with allegations, but refused to go to a hospital for treatment, he said.

She also told officers that Critchfield grabbed the boy's arms and treated him roughly, while also refusing to let her feed the family dog, jail papers state.

Critchfield remained in jail on Monday. It was not immediately clear whether he had an attorney.

Utah State Court records show that in December 2010 Critchfield pleaded guilty to felony aggravated assault and obstruction of justice charges in connection with a domestic violence incident.

A judge sentenced Critchfield to a prison term of five years, but suspended the punishment for a 120-day jail term and three years of probation.

mobile devices was up a whopping 173 percent. And the trend seems

Bengals beat Cardinals 23-16, stay in chase

CINCINNATI (AP) ? The stadium was only two-thirds full again. The Cardinals were on another one of their incredible comebacks, threatening to derail the Cincinnati Bengals' surprising playoff surge.

A pair of tangled up feet made the difference.

The Bengals moved one win away from the playoffs Saturday, holding on for a 23-16 victory over Arizona that secured only their third winning record in the past 21 years.

Cincinnati (9-6) can clinch the final AFC wild card berth by beating Baltimore at Paul Brown Stadium next Sunday. The Bengals moved a game ahead of the Jets, who fell to 8-7 with a 29-14 loss to the Giants on Saturday.

"It's been a big year for me and for this team," rookie quarterback Andy Dalton said. "It's something we believed we had a chance to do. We weren't getting much credit from outside. We'll find out next week."

Dalton threw two more touchdown passes, becoming only the fourth rookie to have 20 in a season, and Cincinnati got a break when the NFL's top comeback team tripped itself up in the closing minutes.

Wide-open receiver Early Doucet tripped at the goal line and went down, letting a fourth-down pass fall incomplete with 1:12 left. The Cardinals (7-8) got the ball one more time, but the clock ran out after a completion.

A few minutes later, the Jets' loss put the Bengals in position to reach the playoffs. New York would have won the tiebreaker if both teams won out.

"We started this quite a while ago ? seems like just yesterday," coach Marvin Lewis said. "But now we're right where we want to be at the end."

Their rookie quarterback put them in position.

Dalton threw an 11-yard touchdown pass to Jermaine Gresham and a 19-yarder to Jerome Simpson, who did a somersault over a defender and landed on both feet in the end zone.

Dalton joined Peyton Manning (26), Charlie Conerly (22) and Dan Marino (20) as the only NFL rookies to throw 20 touchdown passes.

Down 23-0 heading into the fourth quarter, the NFL's best comeback team nearly pulled off its most improbable one yet. Arizona took advantage of Cedric Benson's two fumbles, getting a pair of touchdown passes by John Skelton and Jay Feely's field goal with 3:16 left.

The Cardinals then had their chance to pull even. The Bengals ran an all-out blitz on fourth down from the Cincinnati 17-yard line, and Doucet wound up uncovered at the goal line. Skelton lofted the ball into the end zone, but Doucet tripped and fell.

"It was a blitz and nobody was there," Doucet said. "It was one of those deals where I hadn't hooked it up and my feet got tangled. It's a play I should've made. It was my fault. That's a play I normally make."

The Cardinals had their four-game winning streak snapped and were eliminated from playoff contention.

Cincinnati's defense dominated the first three quarters. Arizona didn't cross midfield until Skelton completed a pass with 13:25 to go, but piled up 208 yards in the final quarter.

Skelton started for the second consecutive week in place of Kevin Kolb, who hasn't fully recovered from a concussion. Skelton was 23 of 44 for 297 yards with three interceptions and five sacks that helped the Bengals get the 23-0 lead.

It could have been worse. Mike Nugent, the NFL's most accurate kicker, missed field goals of 35 and 48 yards in the first half.

Arizona has rallied from fourth-quarter deficits six times this season, one shy of the NFL record. The Cardinals have won three games in overtime, tying the league record.

They couldn't do it one more time.

"Yeah, we're a second-half team," Skelton said. "That's how it has been all year. But in the end, it was too little, too late."

Dalton was 18 of 31 for 154 yards and two touchdowns on a sunny, 39-degree afternoon in front of only 41,273 fans. The Bengals have sold out only one of their seven home games, when the Steelers brought thousands of fans.

Dalton's second touchdown pass had a highlight finish.

Simpson got open for a catch-and-run to the goal line. With Daryl Washington between him and the end zone, Simpson jumped and twirled past the linebacker, landing on both feet in the end zone and raising both arms like a triumphant gymnast.

"One of the key parts for me was I stuck the landing," Simpson said. "I stuck the landing like a gymnast. That was probably one of the most surprising of all the plays in my career. It was pretty awesome, I thought."

For most of the game, the Cardinals couldn't do anything right. Rookie cornerback Patrick Peterson picked off a Dalton pass in the third quarter, but the interception was nullified by Arizona's second roughing-the-passer penalty of the game.

Worse, Peterson hurt his left hamstring on the play, pulling up on the return. The first-round pick left the game and didn't return. He wore a protective boot after the game.

"He's got a strain, it's not a tear," coach Ken Whisenhunt said. "We're fortunate that it doesn't appear to anything long term."

Notes: Beanie Wells became the first Cardinal to run for 1,000 yards and 10 touchdowns in a season. ... After the game, the Bengals made a buy-one, get-one-free offer to season ticket holders, trying to fill the stadium for the final game. ... A.J. Green, playing with a strained right shoulder, had two catches for 25 yards. He passed Cris Collinsworth's club record for a rookie with 1,013 yards on the season.

(AP) ? Scuffles broke out and police were brought in to quell unrest that nearly turned into riots across the nation Friday following the release of Nike's new Air Jordan basketball shoes ? a retro model of one of the most popular Air Jordans ever made.

The mayhem stretched from Washington state to Georgia and was reminiscent of the violence that broke out 20 years ago in many cities as the shoes became popular targets for thieves. It also had a decidedly Black Friday feel as huge crowds of shoppers overwhelmed stores for a must-have item.

In suburban Seattle, police used pepper spray on about 20 customers who started fighting at the Westfield Southcenter mall. The crowd started gathering at four stores in the mall around midnight and had grown to more than 1,000 people by 4 a.m., when the stores opened, Tukwila Officer Mike Murphy said. He said it started as fighting and pushing among people in line and escalated over the next hour.

Murphy said no injuries were reported, although some people suffered cuts or scrapes from fights. Shoppers also broke two doors, and 18-year-old man was arrested for assault after authorities say he punched an officer.

"He did not get his shoes; he went to jail," Murphy said.

The $180 shoes went on sale Friday in a limited release at stores, and the lines began forming several hours before businesses opened.

As the crowds kept growing through the night, they became more unruly and ended in vandalism, violence and arrests.

A man was stabbed when a brawl broke out between several people waiting in line at a Jersey City, N.J., mall to buy the new shoes, authorities said. The 20-year-old man was expected to recover from his injuries.

In Georgia, officers said they had to break a car window to get two toddlers out after a woman went in after the shoes. They said she was taken into custody when she returned to the car.

In Richmond, Calif., police say crowds waiting to buy the Air Jordan 11 Retro Concords at the Hilltop Mall were turned away after a gunshot rang out around 7 a.m.

No injuries were reported, but police said a 24-year-old suspect was taken into custody. The gun apparently went off inadvertently, the Contra Costa Times reported.

Seventeen-year-old Dylan Pulver in Great Neck, N.Y., said he's been looking forward to the release of the shoes for several years, and he set out at 4:30 a.m. to get a pair. After the first store he tried was too crowded, he moved on to a second location and scored a pair.

"I probably could have used a half a size smaller, but I was just really happy to have the shoe," he said.

The frenzy over Air Jordans has been dangerous in the past. Some people were mugged or even killed for early versions of the shoe, created by Nike Inc. in 1984.

The Air Jordan has since been a consistent hit with sneaker fans, spawning a subculture of collectors willing to wait hours to buy the latest pair. Some collectors save the shoes for special occasions or never take them out of the box.

A new edition was launched each year, and release dates had to be moved to the weekends at some points to keep kids from skipping school to get a pair.

But the uproar over the shoe had died down in recent years. These latest incidents seem to be part of trend of increasing acts of violence at retailers this holiday shopping season, such as the shopper who pepper-sprayed others at a Wal-Mart in Los Angeles on Black Friday and crowds looting a clothing store in New York.

Nike issued a statement in response to the violence that said: "Consumer safety and security is of paramount importance. We encourage anyone wishing to purchase our product to do so in a respectful and safe manner."

The retro version of the Air Jordan 11 was a highly sought-after shoe because of the design and the fact that the original was released in 1996 when Jordan and the Bulls were at the height of their dominance.

Pulver said they were a "defining shoe in Jordan's career."

Other disturbances reported at stores in places like Kentucky and Nebraska ranged from shoving and threats to property damage.

In Taylor, Mich., about 100 people forced their way into a shopping center around 5:30 a.m., damaging decorations and overturning benches. Police say a 21-year-old man was arrested.

In Toledo, Ohio, police said they arrested three people after a crowd surged into a mall.

In Lithonia, Ga., at least four people were apparently arrested after customers broke down a door at a store selling the shoes. DeKalb County police said up to 20 squad cars responded.

In Northern California, two men were arrested at a Fairfield mall after crowds shoved each other to get in position for the Nikes, police said.

In Stockton, Detective Joe Silva said a person was taken into custody at Weberstown Mall on suspicion of making criminal threats involving the shoes. Police also were investigating an attempted robbery in the mall's parking lot. The victim was wrongly believed to have just purchased Air Jordans.

In Tukwila, Officer Murphy said the crowd was on the verge of a riot and would have gotten even more out of hand if the police hadn't intervened.

About 25 officers from Tukwila and surrounding areas responded. Murphy said police smelled marijuana and found alcohol containers at the scene.

"It was not a nice, orderly group of shoppers," Murphy said. "There were a lot of hostile and disorderly people."

The Southcenter mall's stores sold out of the Air Jordans, and all but about 50 people got a pair, Murphy said.

Shoppers described the scene as chaotic and at times dangerous.

Carlisa Williams said she joined the crowd at the Southcenter for the experience and ended up buying two pairs of shoes, one for her and one for her brother. But she said she'll never do anything like it again.

"I don't understand why they're so important to people," Williams told KING-TV. "They're just shoes at the end of the day. It's not worth risking your life over."

Judge upholds TV producer's extradition to Mexico (AP)

LOS ANGELES ? A Los Angeles federal judge on Wednesday upheld former reality show producer Bruce Beresford-Redman's extradition to Mexico to face charges in his wife's death.

U.S. District Judge Philip S. Gutierrez wrote that there are many pages of competent evidence supporting prosecution claims that the producer killed his wife during a family vacation in Mexico last year.

The Emmy-nominated producer of "Survivor" has been jailed in Los Angeles since November on a fugitive warrant.

His attorneys filed a petition for writ of habeas corpus in August arguing that his detention was not supported by facts in the case. Gutierrez disagreed, saying all evidence points to a homicide committed by Beresford-Redman.

He cited "pages upon pages of competent evidence demonstrating that the fugitive committed the offense for which extradition was sought, namely the aggravated homicide of the victim."

Gutierrez said materials presented to him documented "the infidelity, fighting, screaming from the hotel room, the fugitive's opportunity to dispose of the victim's body" and other evidence including scratches and abrasions fund on Beresford-Redman's body and his flight to avoid arrest in Mexico.

"All of this evidence points to homicide committed by the fugitive," said the judge's two-page ruling.

Beresford-Redman's attorney, Richard Hirsch, said he was weighing his options in the case and would make a statement later.

Hirsch could appeal the decision to the 9th U.S. Circuit Court of Appeals. If he does not appeal further, U.S. Attorney's spokesman Thom Mrozek said Mexico's extradition request would be submitted to U.S. Secretary of State Hillary Rodham Clinton for final disposition.

Prosecutors have presented statements from hotel guests who said they heard loud arguing and cries of distress coming from the couple's room on the night Monica Beresford-Redman went missing. Her body was found days later in a sewer cistern not far from the room the couple shared with their young children.

The producer's attorneys have claimed the noises came from Beresford-Redman and his children playing loud games throughout the night. They introduced statements from the couple's 6-year-old daughter to corroborate the claim, but judges who have reviewed the case were not swayed.

If he is convicted of aggravated homicide in Mexico, Redman faces 12 to 30 years in a Mexican prison.

Laura Prudom: 'The X Factor' Winner Revealed: Melanie Amaro Beats Chris Rene & Josh Krajcik

The winner of "The X Factor" is ...

Melanie Amaro.

After her name was announced, Melanie was utterly speechless. All she could do was whisper, "Oh my god," several times when Steve Jones tried to get a comment out of her. Her family rapidly rushed the stage to hug her, while her mentor, Simon Cowell, commented: "America, thank you for giving this girl an opportunity ... She is a star, I'm very proud and very grateful."

Somehow, Melanie was expected to perform after hearing the news. It was perhaps the first time all season that she sounded less than perfect. She was understandably forgetting the words and missing her cues as she sobbed, surrounded by family and the other contestants.

After the performance, she finally managed to gather herself enough to address her fans. "Thank you so much," she sobbed. "I don't even know what to say -- God is good!" Simon Cowell succinctly summed up the night by insisting, "We came here to find a superstar and we found a superstar."

Josh Krajcik came in second. Chris Rene came in third.

If you're interested in what happened during the rest of the show, here are some highlights:

We kicked off with a supremely awkward group number (what else is new?) in which the final 12 performed Lady Gaga's "The Edge of Glory" with no discernable sense of timing or harmony. Thankfully, some enterprising individual backstage made certain that Lakoda Rayne's microphones were turned down, but there was no disguising how shaky Chris Rene sounded and Rachel Crow pretty much shouted her lines. An inauspicious start, to say the least.

The final three then had the opportunity to perform one more time -- without the added pressure of shilling for votes. Melanie was up first with a typically Mariah-esque rendition of "All I Want For Christmas Is You," which was note-perfect, as always. She was certainly the most vocally accomplished finalist, but I do understand the concerns of her critics who argue that her performances all sound the same or seem derivative of other artists. Because her tone is similar to the Whitneys, Mariahs and Beyonc?s of the world, it will be far harder for her to carve out a niche for herself in the crowded female music marketplace, while Josh and Chris undeniably have more unique sounds. L.A. praised Melanie enthusiastically (for once), insisting, "That beautiful voice you have is the best friend a song has ever met." Nicole took the opportunity to get in one more nonsensical critique, calling Melanie a "princess goddess warrior."

Chris followed with "Have Yourself a Merry Little Christmas," and no matter how much I respect and admire the guy for how far he's come, he still can't carry a tune. He hit some smooth notes in his upper register, and warmed up to the song as it progressed, but ... yikes. Simon admitted that the competition would not have been the same without Chris, calling him an inspiration. Paula called him stylish and stylized and in possession of great style (we have a new drinking game!), before dubbing him the "most original" contestant.

Last up was Josh, with a raspy and engaging rendition of "Please Come Home For Christmas." He seemed confident and comfortable on the stage, without any need for gimmicks. I think Simon was completely right when he predicted that Josh would sell a lot of records in the future. L.A. admitted (rightly) that judging Josh has been the toughest this year. "You've been so good that I'm always at a loss for words when it comes to you," he said, while Paula called him "magical."

Then came an unlikely duet of "The Christmas Song" between Justin Bieber and Stevie Wonder (I wonder how much of a bump the ratings got thanks to the Beliebers), before the teen pop icon tackled "Santa Claus is Coming to Town" solo. Bieber brought Drew out to sing the last line and made my cold, cynical heart melt; what would "The X Factor" finale be without one last teenage meltdown? Steve Jones acted like the drunken uncle who embarrasses you every year at Christmas dinner, by pointing out that Drew's dream was to hold hands with Justin on a beach as they watched the sun go down. Classy, Steve -- this is why everyone wants you fired. I am MORTIFIED on Drew's behalf, but she took it with grace and good humor, and I'm not going to lie, I'm thrilled for her; that moment was probably as good as winning the whole competition to her.

With much fanfare and prevaricating, our third-place contestant, Chris Rene, was revealed. I've got to say, I was shocked (and pleased) that the voters didn't let a compelling back-story distract them from vocal weakness, and I know that Chris will go on to sell plenty of records under either L.A. or Simon's tutelage, so it doesn't feel like much of an injustice. Chris remained a gentleman to the end, remarking, "I feel amazing that I got to do this, that I'm here, and that God has blessed me with so many opportunities. I've just gotta say thank you." L.A. insisted that he was still proud of his contestant and that Chris was still his man.

Then Steve did a terrible job of corralling Josh and Melanie back to the stage, leading to an abrupt cut to commercials. When we returned, we marched right back into awkwardsville by revisiting the top five most shocking moments of the season, culminating in Rachel Crow's traumatic elimination. Luckily, Rachel then joined our hapless host on stage to prove that she hasn't been committed to any kind of psychiatric facility following her breakdown, and after reassuring her fans that good things are coming soon for her, she told Steve that she wanted to steal his job. Can I register my approval of this idea now? Her 20 seconds reading from the teleprompter seemed more natural and charismatic than Steve has appeared all season. She introduced Leona Lewis, who proceeded to show everyone how it's done with a flawless rendition of "Run."

So. Much. Filler.

50 Cent and the L.A. Lakers took the stage for "Wait Until Tonight" and "In Da Club," the latter of which also featured Astro, who held his own admirably. Is 50 Cent any more relevant than Avril Lavigne these days, though? After an embarrassing Nicole vs. Paula "cry-off" segment, they rolled out Pitbull featuring Ne-Yo (and Marcus Canty!), and I found my will to live rapidly eroding.

Melanie and Josh then gave us a very cute duet of "Heroes" that proved to be an excellent showcase for their talents, even if their voices didn't mesh particularly well on the harmonies. The two had great chemistry, but I was mostly just relieved that Chris wasn't part of the final two, since there's no way he could've held his own against Melanie or Josh's crisp vocals.

Then, at long, long last, the winner was finally revealed, and Melanie's tearful celebration was hard-earned and incredibly touching. Josh was a graceful runner-up, praising his competition for her great voice and remarking that he was glad that he had been able to be himself and sing the songs that he wanted to sing throughout the competition.

So Melanie Amaro has been crowned our first ever champion of "The X Factor" in the U.S., with a Pepsi commercial and massive recording contract to keep her occupied. We may never know if it was pure talent that won her the top spot, or Simon Cowell's careful PR management that painted her as an underdog, even when she was the strongest competitor; but based on vocal talent, the Floridian was undeniably deserving.

Still, some burning questions remain: Will the cardboard cutout that passes for a host, Steve Jones, return to abruptly cut off the judges and inadvertently insult the losers again next season? Will Nicole Scherzinger be entrusted with mentoring another batch of competitors when she seems to think that she still is one? Will more people tune in? We'll find out next year.

Supreme Court Cookbook: 'Chef Supreme' Features 50 Recipes From Ginsburg's Late Husband

WASHINGTON -- U.S. Supreme Court Justice Ruth Bader Ginsburg's children banished her from the kitchen decades ago ? her tuna fish casserole the target of family jokes. Dinner duties instead fell to her husband, an accomplished tax lawyer who became a talented chef.

When he died last year, Martin Ginsburg left behind well over 100 recipes he had perfected, including cookies beloved by his grandchildren and cakes baked for the birthdays of Supreme Court justices. Now, with the help of another high court justice's wife, those recipes have become a cookbook.

"Chef Supreme: Martin Ginsburg" was published this month. It contains nearly 50 of Ginsburg's creations, ranging from a five-page treatise on the perfect baguette to a frozen lime souffle favored by his wife.

Ginsburg said her husband would be overjoyed.

"He was quite an artist in the kitchen, and he wanted to communicate to others the pleasure that he derived from making something successfully," Ginsburg said in a telephone interview.

If he hadn't become an attorney, he might have gone to culinary school, she said.

"My husband was a great tax lawyer, but we had more cookbooks than tax books at home. We had an entire section in the living room ? three sets of shelves from floor to ceiling ? with nothing but cookbooks," she said, adding that he read them with the same interest he read mystery novels.

After Martin Ginsburg's death from cancer at the age of 78, Martha-Ann Alito, the wife of Justice Samuel Alito, proposed compiling a cookbook in his memory. Alito said in an e-mail that the idea came to her when the spouses were gathered together at the court.

"One of the goals as spouses is to be supportive to each other as well as the court family. Marty led the way with perfect pitch," she wrote, adding that Ginsburg's "culinary creations awed and delighted."

With the help of the Supreme Court Historical Society and a CD of Ginsburg's recipes, which he had typed so he could easily share them with dinner guests, about 150 of his recipes were whittled down to 47. Only one of his three recipes for celery root made the cut, for example. The editors also tried to choose recipes he cooked often and those that showed his humor and knack for explaining.

Cooks who attempt his Decadent Chocolate Bombe, for example, are told that, "Only a crazy person would try to make this dessert on a single day." A recipe for shrimp pasta says whole milk can be substituted for heavy cream, in which case: "your sauce will still be very good and your arteries not so bad." And his instructions for Chicken Liver Pate, which involve lighting apple brandy on fire, explain, "Your ceiling is not likely to burn."

"When the going is going to get tough, he tells you ahead of time," said the book's editor, Clare Cushman.

Martin Ginsburg met his future wife on a blind date when they were both undergraduates at Cornell University in New York. The couple entered Harvard Law School a year apart, though she finished her degree at Columbia University when her husband took a job in New York. He followed her to Washington in 1980 when she became a federal judge, taking a position as a professor at Georgetown Law School.

Around that time, their children decided that dad's cooking ? until then reserved for weekends and special occasions ? was vastly superior to mom's.

"I was phased out of the kitchen by my food-loving children," Ginsburg said.

Martin Ginsburg explained the result this way: "As a general rule," he said in 1997, "my wife does not give me any advice about cooking, and I do not give her any advice about the law. This seems to work quite well on both sides."

His wife's biggest booster, he enthusiastically took on the role of Supreme Court spouse after President Bill Clinton appointed her to the court in 1993, making her the second female justice. He was a regular participant in lunches held by the justices' spouses, and interspersed throughout the 126-page cookbook are their remembrances. For example, Maureen Scalia, wife of Justice Antonin Scalia, remembers Ginsburg volunteering to make fresh bread for an event when he learned she planned to use store-bought.

The Supreme Court gift shop began selling the cookbook in early December, and the Supreme Court Historical Society's website also sells it. The first printing sold out and another is under way. Profits from the book, which costs $24.95, go to the society to support programs and scholarship on the court.

Ginsburg said she hasn't tried to make any of her husband's recipes and hasn't taken up cooking since his death. Their daughter, who inherited her father's love of cooking, visits once a month to fill the justice's freezer with dishes.

Ginsburg said she never understood her husband's delight at spending hours in the kitchen.

"I could spend hours writing an opinion. But when it's done it's there on paper, and I can see it again," she said. "What Marty made was consumed too quickly, but he didn't regard it that way."

Last night I found myself cold in my house and needing to tidy up before my mom arrived for a short visit. Rather than bury myself under blankets on the couch, I vacuumed. Within a few minutes, I was warm from lugging my Bissell around and happy to be getting the job done. Similarly, I find that I don't mind handwashing dishes so much in the winter because I enjoy the warm water.

If you really hate doing chores, of course, you could just head to your computer room and play video games?I find sitting at my computer is consistently much warmer than my TV room.

NASA's RXTE detects 'heartbeat' of smallest black hole candidate

An international team of astronomers has identified a candidate for the smallest-known black hole using data from NASA's Rossi X-ray Timing Explorer (RXTE). The evidence comes from a specific type of X-ray pattern, nicknamed a "heartbeat" because of its resemblance to an electrocardiogram. The pattern until now has been recorded in only one other black hole system.

Named IGR J17091-3624 after the astronomical coordinates of its sky position, the binary system combines a normal star with a black hole that may weigh less than three times the sun's mass. That is near the theoretical mass boundary where black holes become possible.

Gas from the normal star streams toward the black hole and forms a disk around it. Friction within the disk heats the gas to millions of degrees, which is hot enough to emit X-rays. Cyclical variations in the intensity of the X-rays observed reflect processes taking place within the gas disk. Scientists think that the most rapid changes occur near the black hole's event horizon, the point beyond which nothing, not even light, can escape.

Astronomers first became aware of the binary system during an outburst in 2003. Archival data from various space missions show it becomes active every few years. Its most recent outburst started in February and is ongoing. The system is located in the direction of the constellation Scorpius, but its distance is not well established. It could be as close as 16,000 light-years or more than 65,000 light-years away.

The record-holder for wide-ranging X-ray variability is another black hole binary system named GRS 1915+105. This system is unique in displaying more than a dozen highly structured patterns, typically lasting between seconds and hours.

"We think that most of these patterns represent cycles of accumulation and ejection in an unstable disk, and we now see seven of them in IGR J17091," said Tomaso Belloni at Brera Observatory in Merate, Italy. "Identifying these signatures in a second black hole system is very exciting."

In GRS 1915, strong magnetic fields near the black hole's event horizon eject some of the gas into dual, oppositely directed jets that blast outward at about 98 percent the speed of light. The peak of its heartbeat emission corresponds to the emergence of the jet.

Changes in the X-ray spectrum observed by RXTE during each beat reveal that the innermost region of the disk emits enough radiation to push back the gas, creating a strong outward wind that stops the inward flow, briefly starving the black hole and shutting down the jet. This corresponds to the faintest emission. Eventually, the inner disk gets so bright and hot it essentially disintegrates and plunges toward the black hole, re-establishing the jet and beginning the cycle anew. This entire process happens in as little as 40 seconds.

While there is no direct evidence IGR J17091 possesses a particle jet, its heartbeat signature suggests that similar processes are at work. Researchers say that this system's heartbeat emission can be 20 times fainter than GRS 1915 and can cycle some eight times faster, in as little as five seconds.

Astronomers estimate that GRS 1915 is about 14 times the sun's mass, placing it among the most-massive-known black holes that have formed because of the collapse of a single star. The research team analyzed six months of RXTE observations to compare the two systems, concluding that IGR J17091 must possess a minuscule black hole.

"Just as the heart rate of a mouse is faster than an elephant's, the heartbeat signals from these black holes scale according to their masses," said Diego Altamirano, an astrophysicist at the University of Amsterdam in The Netherlands and lead author of a paper describing the findings in the Nov. 4 issue of The Astrophysical Journal Letters.

The researchers say this analysis is just the start of a larger program to compare both of these black holes in detail using data from RXTE, NASA's Swift satellite and the European XMM-Newton observatory.

"Until this study, GRS 1915 was essentially a one-off, and there's only so much we can understand from a single example," said Tod Strohmayer, the project scientist for RXTE at NASA's Goddard Space Flight Center in Greenbelt, Md. "Now, with a second system exhibiting similar types of variability, we really can begin to test how well we understand what happens at the brink of a black hole."

Launched in late 1995, RXTE is second only to Hubble as the longest serving of NASA's operating astrophysics missions. RXTE provides a unique observing window into the extreme environments of neutron stars and black holes.

Panetta becomes first Pentagon chief to visit Libya

TRIPOLI - U.S. Defense Secretary Leon Panetta arrived in Tripoli Saturday, taking advantage of the ouster of Moammar Gadhafi in an eight-month civil war to become the first Pentagon chief to set foot on Libyan soil.

But Panetta has indicated that the U.S. will give more time to gain control of the militias that overthrew Gadhafi before determining how to help the fledgling government.


"The last thing you want to do is to try to impose something on a country that has just gone through what the Libyans have gone through," said Panetta on Friday before landing in Tripoli.

"They've earned the right to try to determine their future. They've earned the right to try to work their way through the issues that they're going to have to confront," he said.

Libya's weak interim government is struggling to assert control two months after the capturing and killing of Gadhafi.

Late Thursday the International Criminal Court said his violent killing may have been a war crime.

Panetta will meet with members of the transitional government in Tripoli on Saturday, and make an emotional visit to what historians believe is the gravesite of 13 U.S. sailors killed in 1804. Those deaths were caused by the explosion of the U.S. ship Intrepid, which was slipping into the Tripoli harbor to destroy pirate ships that had captured an American frigate.

While eager to encourage a new democracy that emerged from Libya's Arab Spring revolution, the U.S. is wary of appearing as trying to exert too much influence after an eight-month civil war. At the same time, however, leaders in the U.S. and elsewhere worry about how well the newly formed National Transitional Council can resolve clashes between militia groups in the North African nation.

Sanctions lifted
Ahead of Panetta's visit, the Obama administration announced it had lifted sanctions the U.S. imposed on Libya in February to choke off the Gadhafi regime's funds while it was violent suppressing peaceful protests. The U.S. at the time blocked some $37 billion in Libyan assets, and a White House statement said Friday's action "unfreezes all government and central bank funds within U.S. jurisdiction, with limited exceptions."

Recovery of the assets "will allow the Libyan government to access most of its worldwide holdings and will help the new government oversee the country's transition and reconstruction in a responsible manner," the White House said.

But the continuing violence in Libya, including recent skirmishes between revolutionary fighters and national army troops near Tripoli's airport, reflects the difficulties that Libya's leaders face as they try to forge an army, integrating some of the militias and disarming the rest.

Officials acknowledge that process could take months, and that they can't force the militias to go along.

Panetta told reporters Friday that his visit to the Libyan capital will give him a better sense of the situation and allow him to pay tribute to the people for bringing down Gadhafi and trying to establish a democratic government.

"It seems to me they are working through some very difficult issues to try to bring that country together," said Panetta. "It's not going to be easy. This is not a country that has a tradition of democratic institutions and representative government. This is going to take some work "

US to provide assistance
But he said he has seen indications that the Libyans are making progress.

"I think that any country like Libya that was able to do what they did and show the courage that they did in making the changes that took place there ? I'm confident that ultimately they're going to be able to succeed in putting a democracy together," he said.

Panetta said the U.S. is prepared to provide Libya any assistance it needs.

By traveling to Libya, however, Panetta was highlighting the different approaches that the U.S. and other countries are taking with respect to rebellions against tyrannical leaders.

The U.S. and NATO provided months of military power and assistance to the Libyan rebels, but officials have made it clear they do not intend to do the same in Syria despite the furor over President Bashar Assad's crackdown on pro-reform demonstrators.

Panetta, who met with Turkish officials Friday, said they did not discuss any specific steps to increase pressure on Assad to step down.

But they talked about the need to work together with other nations to "get Assad to do the right thing."

At some point, he said, he believes that the type of uprisings that happened in Libya and elsewhere across the Middle East will take place in Syria.

Congress spars over payroll tax-cut extensions: What does it mean for you? (The Ticket)

Senate Democrats on Monday introduced an altered proposal to extend payroll tax cuts ahead of their expiration Dec. 31. But it's far from clear whether the Senate proposal can break the current stalemate over the issue in Washington.

At stake is a temporary tax break that affects nearly every employed American-- an estimated 160 million people, according to the White House. The break lowers the Social Security payroll tax for employees from 6.2 percent to 4.2 percent. But the provision is set to expire Dec. 31--meaning that if Congress fails to pass an extension, workers will be paying 2 percent more in Social Security taxes in the year head. That higher rate works out to an average of $1,000 for a typical middle-class family, according to the White House. Democrats are trying to couple their proposal payroll-tax cut with a similar extension of federal unemployment benefits, which are likewise set to expire at year's end.

The Democrats' plan will reportedly propose a further payroll tax reduction from 4.2 to 3.1 percent. The official plan had not yet been released as of Monday afternoon.

President Obama on Monday warned lawmakers to extend payroll tax cuts and unemployment benefits--or else risk hurting American families during the holiday season.

"It would be a terrible mistake for Congress to go home for the holidays" without extending unemployment insurance and leave "1.3 million Americans out in the cold," Obama said at a White House news conference.

Democrats and select Republican leaders such as Senate Minority Leader Mitch McConnell (R-Ky.) have voiced support for extending the payroll tax cut, but the parties have failed to find common ground about how the government would go about paying for it.

The new Democratic proposal unveiled Monday by Senate Majority Leader Harry Reid of Nevada included a plan that had been a past sticking point for Republicans--a surtax on Americans earning more than $1 million. But Reid said Democrats have now agreed to make that surtax temporary in order to corral some Republican support.

"The scaled-back, temporary tax on the very richest Americans?a group with an average income of $3 million a year?is also a sincere attempt to get Senate Republicans on board," Reid said in a Senate floor speech Monday afternoon, according to prepared remarks.

Reid argued that wealthy earners, a supermajority of Republicans, plus a majority of the tea party all support having the country's top income earners pay more in taxes. "Republicans in Congress dismiss [this temporary tax] at their peril. The American people are watching," Reid warned.

To drive that point home, the White House on Monday unveiled a timer available on the White House's website to count down the days until "middle class tax increases" take effect.

Democrats immediately depicted their new proposal as a "compromise" Monday, but Republican leaders countered that they had yet to see or judge the proposal before Democrats decided unilaterally to characterize it as a compromise.

Bank of China to step in as Saab part owner: source (Reuters)

STOCKHOLM (Reuters) ? Saab's Dutch owner and China's Zhejiang Youngman Lotus Automobile have agreed that the Bank of China, the nation's fourth-largest bank by market value, will come in as part owner of the ailing carmaker, according to a source familiar with the deal.

Under the new deal, the Bank of China will replace Chinese investor Pang Da Automobile Trade Co. Youngman and the Bank of China will own just under 50 percent of the company.

The move could help pave the way for an approval by General Motors, which still has preferential shares in Saab and rejected an earlier rescue plan. It said in November it would stop supplying components and technology if Youngman and Pang Da succeeded with their acquisition bid.

Saab has lurched from crisis to crisis in the past year. The company has not produced a car in months because of unpaid salaries and bills.

The new plan has been handed over to GM.

Saab was not immediately available to comment.

The company is currently under court protection from creditors in Sweden after unions representing Saab employees began proceedings to put it into bankruptcy over unpaid wages.

Pang Da operates auto dealerships in China while Youngman produces commercial vehicles, including buses and trucks, and sells cars under the Lotus brand.

GM operates in China in a partnership with state-run automaker SAIC Motor Corp Ltd.

Romney, Gingrich focus of GOP race with Cain exit

(AP) ? With the implosion of Herman Cain's campaign amid accusations of adultery and sexual harassment, the once-crowded 2012 Republican presidential field appears to be narrowing to a two-man race between Mitt Romney and Newt Gingrich.

GOP voters have one month before the leadoff Iowa caucuses. Gingrich is showing strength in the latest Iowa poll, while Romney is strong in New Hampshire, site of the first primary.

Romney has maintained a political network since his failed 2008 presidential bid, especially in New Hampshire. Gingrich, whose campaign nearly collapsed several months ago, is relying on his debate performances and the good will he built up with some conservatives as a congressional leader in the 1980s and 1990s.

Gingrich's efforts appear to be paying off in Iowa. A Des Moines Register poll released late Saturday found the former House speaker leading the GOP field with 25 percent support, ahead of Ron Paul at 18 percent and Romney at 16.

Cain's suspension of his campaign Saturday, and Texas Gov. Rick Perry's continued struggles to make headway with voters, have focused the party's attention on Romney, a former Massachusetts governor, and Gingrich, a one-time congressman from Georgia. They offer striking contrasts in personality, government experience and campaign organization.

Their political philosophies and differences are a bit harder to discern. Both men have changed their positions on issues such as climate change. And Gingrich, in particular, is known to veer into unusual territories, such as child labor practices.

Romney has said he differs with Gingrich on child labor laws. Gingrich recently suggested that children as young as nine should work as assistant school janitors, to earn money and learn work ethics.

Cain's announcement in Atlanta offered a possible opening for Romney or Gingrich to make a dramatic move in hopes of seizing momentum for the sprint to the Jan. 3 Iowa caucus. Neither man did. They appear willing to play things carefully and low-key for now.

At a town hall meeting in New York sponsored by tea party supporters, Gingrich declined to characterize the race as a direct contest between himself and Romney. Any of the remaining GOP contenders could stage a comeback before the Iowa caucuses, he said. "I'm not going to say that any of my friends can't suddenly surprise us," Gingrich said.

But once high-flying contenders such as Perry and Rep. Michele Bachmann of Minnesota have not managed to bounce back so far, despite weeks of trying.

Cain's once-prospering campaign was undone by numerous allegations of sexual wrongdoing.

Gingrich, twice divorced and now married to a woman with whom he had an extramarital affair, has been the most obvious beneficiary of Cain's precipitous slide.

But Perry, Bachmann and possibly others are likely to make a play for Cain's anti-establishment tea party backing. Time is running short for them to establish themselves as the top alternative to Romney, who has long been viewed with suspicion by many conservatives.
